Prosecution Immigration Status The 23rd District Attorney’s Office believes justice should be impartial and objective, treating all individuals equally, regardless of their status or identity. The Office advocates for justice on behalf of victims with equal force, regardless of a victim’s immigration status. The Office also is committed to the equal treatment of defendants, regardless of their immigration status. Colorado and United States law requires defendants be advised of potential immigration consequences before entering into a plea agreement. The Office adheres to this legal requirement and gives defendants the opportunity to seek advice from an immigration attorney concerning potential immigration consequences prior to entering into a plea agreement, should a defendant so desire. The Office does not offer better or worse plea bargains simply because of the immigration status of a defendant. Defendants are treated equally without regard to their immigration status.
